Mare roped, drug into trailer and later shot in contested BLM Colorado roundup

New York, NY (October 15, 2010)—A New York Federal District Court Judge will consider a request on October 20 to stop the federal government’s roundup and removal of Colorado’s North Piceance wild horse herd. Second-string contractors, hired by the BLM, already have killed one mare who attempted to escape with her baby. They roped her, choked her down, kicked her and then dragged her into the trailer. Yesterday the mare was shot. An application for a Temporary Restraining Order/Preliminary Injunction was filed yesterday by the plaintiffs, Habitat for Horses, American Society for the Prevention of Cruelty to Animals (ASPCA), The Cloud Foundation, Toni and Don Moore, DVM in order to stop the roundup. This legal action is co-funded by Habitat for Horses Advisory Council and the ASPCA. 

“The wild horses already rounded up need to be returned to the range now. The BLM must take responsibility for the violent treatment and death of the Colorado mare and the hundreds of mustang deaths this year alone,” asserts Cloud Foundation Director, Ginger Kathrens. 

A hearing has been scheduled in the U.S. District Court in New York City for October 20th where the BLM will be required to defend its North Piceance roundup which is in violation of multiple federal laws .

Wild horses and burros are now mismanaged at levels far below genetic viability across the West, contrary to the guidelines in BLM’s own management handbook. The BLM selectively uses and repeatedly distorts the actual number of wild horses and burros on the range while dismissing their most effective natural predator—the mountain lion—as non-existent. Wild horses are a return-native species to North America and add to the biodiversity of our public lands, improving their ecosystem. There are currently more than 40,000 wild horses and burros in government holding and BLM continues with plans to roundup and remove more than 11,000 this fiscal year. The herds are often replaced with energy development and welfare cattle. More than 100 herds have been completely eliminated since the passage of the Wild Free-Roaming Horses and Burros Act of 1971, along with the theft of more than 24 million acres of land designated for their use. 

54 members of Congress asked the BLM to cease roundups in July, joining the call for an immediate moratorium on roundups. A congressionally-requested National Academy of Sciences investigation will begin early in 2011 but will come too late for thousands of wild horses and burros without an immediate halt to the taxpayer-funded roundups.

Kathrens continues, “In my opinion the BLM has lost the privilege of managing America’s wild horses and burros. It is time to create a new Bureau that works to sustain and protect our celebrated herds—not eradicate them.” More

Destruction of Largest Wyoming Wild Horse Herd Underway Despite Public Outcry

Wild horse mare dies in costly and unnecessary roundup 

Rock Springs, WY (October 12, 2010)—Amid nationwide protests, today 122 more healthy wild horses were rounded up by helicopter in the Adobe Town/Salt Wells Wild Horse Herd Management Area Complex. The current three-day roundup total is 320, not including one mare who died on the run yesterday. The National Academy of Sciences will begin it’s Congressionally-requested investigation of the Bureau of Land Management’s (BLM) wild horse and burro program in 2011 but it will too late for the Red Desert herds without an immediate moratorium on roundups

This removal is estimated to cost at least $3.5 million in taxpayer dollars and will leave the celebrated Adobe Town/Salt Wells Wild Horse Range—already populated with oil and gas wells—nearly devoid of mustangs. Some 40,000 cattle per year are allocated to graze on the 1.5 million acres Complex as well, leaving little room for wild horses according to BLM’s multiple-use interpretation. The BLM plans to continue their operation for six weeks in order to roundup 1950 horses, removing 1580 of them permanently from the Complex. The majority of horses removed will be shipped to the Colorado State Penitentiary in Canon City which doubles as a holding facility for thousands of captured mustangs.

Suit seeks immediate injunction, cites BLM’s violations of four Congressional Acts

New York City, NY (October 7, 2010)— A case filed today against Secretary of Interior Ken Salazar in federal court aims to stop the elimination of wild horses from Colorado’s North Piceance herd area. Plaintiffs Habitat for Horses (HfH), the American Society for the Prevention of Cruelty to Animals (ASPCA), The Cloud Foundation (TCF), Toni Moore and Dr. Don Moore challenge the BLM’s ongoing illegal treatment of wild horses residing on public lands and it’s intention to completely remove all wild horses from this area beginning October 11, 2010.

The Plaintiffs’ attorneys, Bruce Wagman (Schiff Hardin) and Valerie Stanley, are asking the court for an injunction to stop BLM from removing any of these wild horses pending a complete judicial review of the BLM’s conduct. The complaint cites four counts and violations committed by the Bureau of Land Management (BLM): violation of the Wild Free-Roaming Horses and Burros Act, the National Environmental Policy Act, the Information Quality Act and the Federal Land Policy Management Act. The suit has been brought against BLM Director Robert Abbey and Field Manager of the Colorado White River Field Office Kent Walter, in addition to Secretary Salazar.

“The BLM’s ‘shoot from the hip’ policy of indiscriminately destroying and removing long standing wild horse herds has to come to an end,” says R.T. BLM’s failure to instate even a partial moratorium inspires protests around US
Boston, MA (October 7, 2010)— Following over 35 protests in late 2009/2010, rallies will resume this month in at least seven states nationwide to draw attention to the plight of America’s wild horse and burro herds. Protests in 12 more states are in the works. Currently nearly 40,000 wild horses and burros are held in pens and pastures at taxpayer expense while the Bureau of Land Management (BLM) private contractors rush to roundup over 3,200 more wild horses and burros before the end of the year. Despite the delivery of a Unified Moratorium Letter last fall to President Obama, Interior Secretary Salazar and BLM Director Bob Abbey which called for an immediate freeze on all non-emergency roundups—the BLM has not changed course. On July 30th, 54 Congressional Representatives sent a letter to both Secretary Salazar and Director Abbey demanding a moratorium and review of the wild horse and burro program.  Regardless of public and political outrage the BLM has not made an honest effort to work with Congress or the public on solutions and improved management of all of America’s remaining wild horse and burro herds.  More

While law makers and the American public had their eyes concentrated on the much contested Silver King round up in Nevada the Bureau of Land Management (BLM), Fish and Wildlife Service (USFWS) along with helicopter contractor David Cattoor where conducting an unpublished and unannounced secret wild horse gather at the Sheldon National Wildlife Refuge (Sheldon). 

Plaintiff in several suits against the BLM for lack of transparency and violation of First Amendment Rights, Laura Leigh of GrassRootsHorse, was tipped off that there was illicit activity taking place at Sheldon as many roads were closed due to a “wild horse gather”.

On September 22, 2010 Ms. Leigh discussed this situation with wild horse advocate Leslie Peeples, who was already on the road to visit another wild horse herd, and Ms. Peeples immediately changed plans and headed to Sheldon to investigate as no such “gather” was indicated in any public records.

On the morning of Sept. 23, 2010 Ms. Peeples phoned the Lakeview office of the USFWS and when asked if a wild horse gather was being conducted she was told, “yes”. 

Cattoor Truck at Sheldon ~ Photo by Leslie PeeplesMs. Peeples headed out to Sheldon on back roads when she encountered an oncoming semi-truck with a livestock trailer being towed behind it at a reasonable speed.  Ms. Peeples intended to ask the driver where the stampede was taking place so she pulled her car over to the side of the road and stepped out into her lane of traffic to flag the driver down for information.  Upon seeing this, according to filed court documents, the truck driver aimed for the center of the road, speeded up and missed running over Ms. Peoples by only inches.  More

The motion names as defendants Ken Salazar, Bob Abbey, Ron Wenker and the BLM as it asks for an immediate cessation of all helicopter roundups and related activities regarding any and all aspects of actions related to wild horse movement, gathering or roundup as well as any actions involving all the horses in both short and long term holding.  The case has been assigned to the Honorable Judge Hicks who, likewise, is considering Ms. Leigh’s contempt complaint regarding the Tuscarora stampede.

This motion is all about accountability, access, transparency and the First Amendment rights granted to all U.S. citizens under the Constitution.

“This is about the horses, each and every horse. Every individual life that leaves the range matters and is important to the American public. This is not about some bulk inventory and it is about time that the government recognizes that fact. We are not going away. The wild horses and burros are living beings mandated to be managed humanely.” said Maureen VanDerStad of Grass Roots Horse, a nonprofit group based in grass roots activism.  More

A recent article about state governments seizing the rights to rain water off your roof, elicited a comment that almost sounded like it was relevant; until you examined the actual available data.  Because the of the convoluted logic used to make the arguments in this commentary, we felt it necessary to dispel misconceptions many people operate under when it comes to the issue of water rights.  This comment, crafted to look as though the government both state and federal is …..only trying to protect the rights of land owners….is a PR piece; gee….I wonder where this came from?

C.  First, in the western states, water rights are held for the beneficial use by the public and apportioned for use by seniority.

A. At one time this was true, but reinterpretation by the BLM of “public use”, “adequate use” and “beneficial use” have rendered seniority use as a part of property rights, null and void.  This means you have no water rights to speak of; apportioned use is not even a consideration.  Profit is all that matters and many states no longer recognize water rights as belonging to individual land regardless of what the previous statutes and laws were.

Because water is now declared by BLM to be a salable commodity, every effort is made to contract the allocated rights to water, to private corporations for use in strip mining, geo-thermal activities, and for sale to private corporations for diversions to far away places!

These private sellers have first rights to their allocation of water before any water is released to the “public”. On public lands either owned or controlled by the BLM, ALL waters existing above or below the surface belong to and are controlled by the BLM.  They could give a crap if you have water or you don’t.  More

Now if the BLM used half way humane methods of rounding up horses, perhaps we all wouldn’t have sat up and noticed and gotten this outraged.  Using a contractor that has been convicted of killing wild horses? Using Walmart bag whip sticks instead of natural horsemanship? Stuffing scared wild horses in trucks and driving them for hours right after they ran for miles and miles? Rounding them up in the middle of foaling season, in the middle of extreme temperatures?

From the highway it is a beautiful sight. A giant blue lake, with greenery all around and the desert mountains behind it in the stark blue summer sky. Its hard to take your eyes off of the scenery, so be careful driving. Far off in the distance you can barely make out some moving dots next to the lake. They are easily mistaken for a large herd of cows, many blacks and some whites and greys. But they are definitely not cows, they are a most magnificent herd of wild and free roaming horses living in a most spectacular peace of nature, still untouched by man.

Kudo, (founder of Animal Recovery Mission in Miami, working to close the horrendous illegal slaughter farms there) and myself, (founder of Respect4horses in Arizona), have decided to temporarily veer off of our main courses a bit to join forces and go document the wild horse roundups in Twin Peaks, CA. As we are driving on the road towards Fallon, where we want to visit the broken arrow holding facility, we noticed the lake and the dots along side of it and we decide to turn around, just to check in case they might be horses. I am so glad that we did. More

Who is Sue Wallis and Why Should I Care?

The statement in the headline was made to a reporter from the Wyoming Tribune Eagle in late April of this year, by Wyoming State Representative Sue Wallis of Recluse, WY.

On March 9, Wyoming Governor Dave Freudenthal signed into law a bill that enables the Wyoming Livestock Board to send stray, unwanted or feral horses to slaughter. Prior to this legislation, the Board could only send such horses to public sale.  This bill (http://legisweb.state.wy.us/2010/Enroll/HB0122.pdf), was introduced into the Wyoming House on February 11, 2010 by Rep. Sue Wallis, and was signed into law less than 30 days later. 

Upon review, many parts of the bill are quite troublesome (even aside from the fact that horse slaughter is an extremely controversial issue in the US).  In the section in regards to the due diligence required for a Board inspector to determine ownership of an “estray” horse, the horse “cannot be held for more than 10 days” before being sent to slaughter.  Under this language, an inspector could make the decision in 1 hour that the horse was a stray or feral and make the arrangements to have the horse sent to the slaughter facility.  Additionally, it states that “the board shall provide meat from estrays disposed of by slaughter….to Wyoming state institutions or to nonprofit organizations……” meaning among other things prisons, schools and state run health facilities.

It was subtle, it was sweet and done with such professional flair that most people would have missed it on the first go around but a second viewing cements the words and causes the jaws to drop.  Clare Major, of the New York Times, caught on video BLM Wild Horse Stampede contractor Dave Cattoor discussing with his company and BLM personnel the process of killing a horse, that his firm would injure, and how to hide it and dispose of it in such a manner that the public and press would not see it or become aware of the incident.  How sweet is that? 

All the King’s horses and all the King’s men will never be able to put Cattoor’s words back in his mouth again.”

Sunk, doused and caught with his pants down all due to the desire to be “famous” and to appear in the New York Times.  The egos of Dave and Sue Cattoor have finally done them in.

S 510 : Testor Amendment Means Nothing

The Testor Amendment.  – It’ll free my direct sales to consumers. Or so the “opposition” to S. 510 seems to be saying now.

Once I started reading this,  “shock kept me up all night” would be an understatement.

Attempting to understand the logic behind the argument that somehow Legislators and AgriBusiness lobbyists are now “backing down” from the onerous control methods that have been written, fought for, and negotiated since the introduction of S. 510 in March of 2009 – I became even more confused.

Why suddenly would Sally Sunshine be allowed to sell her Strawberries to Safeway with no “involvement” under S 510?

The answer in short is she won’t. The “Grocery Store” will be required to keep records of Sally Sunshine. And in the event of “reasonable belief” or  “reasonable possibility” – Sally Sunshine is going down first.

The language is included here below (partial pages 122 and 123):

(G) GROCERY    STORES.—With    respect to a
17 sale of a food described in subparagraph (H) to
18 a grocery store, the Secretary shall not require
19 such grocery store to maintain records under
20 this subsection other than records documenting

For the purposes of this satirical piece, one will need the following definitions to assist in decoding the secret methods of stripping away the populations nest egg.

SSA : Sorry Suckers All gone : Formerly known as Social Security Administration

GRA : Grab Retirement Assets  : Guaranteed Retirement Accounts

Introduced in the past have been Bills indicating that American Corporations are being irresponsible with their employees monetary investments (401K/IRA) and that the simple little American Folk need protecting from the big bad businesses. In order to do this, Administrations in the past have helped the under-informed idiots (us) by setting up programs that are designed to “help” us save for retirement. Seeing as the Federal Government has done such a fine job with the SSA program (never mind that for the first time since the overhaul in 1983 the program is in the red, is projected to be “less bad” and then recover nicely until it fails again in a few years) – history shows that another “assistance program” might not be such a great idea.

“While defined contribution plans have some strengths relative to defined benefit plans, participants in defined contribution plans bear the investment risk because there is no promise by the employer as to the adequacy of the account balance that will be available or the income stream that can be provided after retirement.” And furthermore, “The Agencies are considering whether it would be appropriate for them to take future steps for them to facilitate access to, and use of, lifetime income or other arrangements designed to provide a stream of income after retirement.”

We’ll just put that little data point at the back of our “unevolved-cannot-make-decisions-for-ourselves” brains until we work forward with this problem. More

Independent Review Too Late for Wild Horses and Burros?
Moratorium on roundups must accompany National Academy of Sciences review
Colorado Springs, CO (August 27, 2010)— The Cloud Foundation fully supports the independent review of the Bureau of Land Management’s (BLM) mismanagement of America’s Wild Horses and Burros by the National Academy of Sciences (NAS), but only if it is coupled with an immediate moratorium on all wild horse and burro roundups. 54 members of Congress requested both the review and an immediate moratorium in a letter sent to Secretary of Interior Salazar on July 31, 2010. Each herd is an integral part of the ecosystem and without a moratorium there will be few genetically viable herds on Western lands in left to study. The NAS review of the flawed Wild Horse and Burro program is scheduled to begin in 2011 and last two years, but at the current rage BLM will have removed tens of thousands more mustangs from their legally designated ranges in 10 western states by then. In just this fiscal year alone, BLM has removed nearly 12,000 wild horses and burros, most warehoused at taxpayer expense.  More

SUSANVILLE, CA (SFTHH) – For weeks the Bureau of Land Management(BLM) has kept the American public and concerned citizens at extreme distances from the wild horse trapping operations at the Twin Peaks helicopter stampede.  Each morning observers must tolerate a law enforcement briefing by BLM Security Chief Jason Parker who clearly states that the public will be held back from the private land, where the trap is located, due to safety and liability issues and should anyone not comply, “things will be escalated to the next level”.  Today that changed when the BLM allowed a New York Times photographer to not only locate himself on the private land but to be within the chute of the trap and exposed to both the horses and the aggressive, low altitude helicopter.

Twin Peaks BLM Helicopter Stampede Day 2, Thursday, August 12th:

Arriving at the Litchfield Holding Facility at around 6:00 a.m., just before dawn, we were briefed by ‘Jeff’, a uniformed BLM representative on the rules of conduct. Most pointed: Disruptions or jeopardizing of safety would discontinue regular observation day. This was punctuated by 3 armed Law Enforcement officers; one, wore a Kevlar vest.Among the Observers were two political Activists, seeking to learn more on the issues of Wild Horses & Burros; a free-lance journalist and her partner; a graduate student, authoring a thesis based on a year of study in this HMA; an older gentleman who has lived the majority of his life in the area. And two additional representatives of the BLM.

A total of 11 Observers – and six non-civilians to attend us. More

Two-Week-Old Wild Horse Shot and Killed Before California Roundup
Advocates ask for investigation
Sacramento, CA (August 13, 2010)—The body of a wild horse foal was found near the site of the Twin Peaks roundup Wednesday by Craig Downer, wildlife ecologist and Cloud Foundation Board member, and Chrystie Davis, wild horse advocate. Davis, an experienced horsewoman, examined the foal for any broken bones. What she found was an apparent rope burn on a rear leg as well as a gunshot wound.
 
 “It seems as though the foal was shot in the gut,” Davis states. “It looked as though the foal was abused, lassoed around the hind legs and dragged.” 
The foal, approximately 2 weeks old, was killed prior to the start of the controversial Twin Peaks Herd Management Area roundup in Northern California. When Davis told BLM officials about finding the gunshot foal, Bureau of Land Management (BLM) employee, Carman Prisco, told Davis she must be confused and the dead animal was an antelope. Photos taken by Downer confirmed that this is indeed a wild horse foal.

Mustang advocates ask BLM law enforcement to conduct a thorough investigation into the abuse and death of the federally protected wild horse—killed before independent contractor, Cattoor Livestock, began rounding up wild horses with helicopters.
Field reports from those on the ground noted a severely injured white stallion that suffered head trauma supposedly from fighting with other stallions in tightly packed transport vehicles. Even though the injury was serious, the BLM contractor was quoted as saying a vet “might need” to be called. The whereabouts of that stallion are currently unknown. Another stallion was off loaded into a pen with eight mules that attacked him, causing traumatic injuries. This incident was also brought to the attention of the BLM by public observers.
Advocates were told yesterday that there were no injuries, yet when they went to look at the horses in holding, the area was blocked off. They were told that they could not access the area because the “injured horses” needed to rest.
Injuries are not uncommon in roundups and underscore the need for public access, says Ginger Kathrens, Director of the Cloud Foundation and EMMY Award-winning producer.
“Access is absolutely essential and is granted by the Constitution,”  says  Kathrens. “The ‘acceptable’ suffering of these horses is simply not acceptable to the caring public.”
Laura Leigh, Cloud Foundation Herd Watch coordinator, agrees.
“If this is what we see when the BLM actually allows us in, what happens when they black out their actions to the press and public?” asks Leigh,  plaintiff for the Tuscarora round-up that ended July 20 in Nevada, “The time for real Congressional intervention is long overdue.”
The recent round-up in Tuscarora, Nevada—also run by Cattoor Livestock—resulted in the deaths of thirty-six wild horses.

“Bob Abbey, for his efforts, was promoted in 2009 and became the national Director of the BLM.  The issue regarding Abbey firing a whistleblower was not raised during his confirmation hearing.  Then, Secretary Ken Salazar also named Abbey interim Director of the Minerals Management Service, “the scandal-ridden agency responsible for the oversight of offshore drilling,” to oversee the cleanup of BP’s Gulf oil spill. “___________________________________

Senator Harry Reid of Nevada, who has been called “the godfather of Nevada’s casino-real estate-development nexus and hard rock mining,” nominated Bob Abbey to be the Director of the Bureau of Land Management (BLM).

What did Bob Abbey do before he became Director of the BLM? 

Well for one thing, as the Nevada State Director of the BLM, Bob Abbey illegally fired Earle Dixon in 2004 for whistleblowing about radioactive uranium contamination from a mine in Nevada.

Earle Dixon, a mine hydrogeology specialist, was the Project Manager overseeing the cleanup of the Yerington Mine at the edge of Yerington in western Nevada.  The Anaconda Copper Co. had mined and processed copper ore at this 3,500 acre site for more than 25 years.  The site was bought by a subsidiary of BP (British Petroleum): ARCO (formerly called Atlantic Richfield).  The cleanup included contaminated groundwater, metal-contaminated mine tailings and radioactive evaporation ponds.   Dixon was trying to protect the health and safety of the cleanup workers and local residents, as well as make sure that the mine cleanup complied with the Toxic Substances Control Act, the Clean Water Act and the Safe Drinking Water Act, and other laws.  Bob Abbey wrote a letter firing Dixon because he “alienated many of the groups that we, as an agency responsible for managing public lands, need to deal with in accomplishing our mission in an efficient and effective manner.”  More

Investigative journalist/author/editor/publisher Steven Long of Houston, Texas has uncovered yet another glaring, corrupt distortion of truth and regulation by controversial Secretary of the Department of Interior (DoI) Ken Salazar’s Bureau of Land Management (BLM).  Within a recent article in Horseback Magazine Long exposes the fact that the BLM’s secret “No Fly Zones” over their aerial attacks on native wild horses is a figment of their own imagination, proving that America has been duped for years by the malevolent federal agency.Press and public alike have always taken the BLM’s warnings at face value but under questioning by Long a Washington based BLM Spin Master gave a polished up answer: 

“…we did consider a TFR for the Nevada gathers, but the field staff learned from the Federal Aviation Administration that gather operations (roundups) currently do not meet the standard criteria…” 

This news comes as a great boon to the bulk of U.S. taxpayers who are collectively banding together in an effort to stop the BLM from moving forward with their inhumane and unnecessary wild horse roundups. 

As of late, the BLM and their helicopter stampede contractors have slipped into a “covert mode” of operations due to increased fear that the truth regarding their questionable operations will be documented by the press and U.S. citizens.  During the deadly Calico Complex roundup, earlier this year, eye witness accounts and photos surfaced of young horses being run to their deaths by helicopters and videos were circulated of the hostile and aggressive manner in which helicopters are utilized to harass and terrify America’s native wild horses.  Since that time, BLM roundups have been conducted under a cloak of secrecy by securing the trap sites and holding areas on private land, therefore ensuring that American citizen’s First Amendment rights cannot be exercised.

Another assault on the American public is under way; this one will enlarge and increase the power of the Department of the Interior and the Bureau of Land Management to such a degree that none of us will be safe from these corrupted and unlawful corporate federal agencies operating under the public deception; “a public service agency”. These are in fact, duly authorized and chartered private corporations which have long since ceased to function as public services, if in fact they ever did.

Those who ramble through the halls of the District of Criminals, who claim they have no time to write the bills; no time to read the bills, somehow found the time to vote to pass this federal, land, asset and natural resource grab, including water rights, through the House.  The bill now rests in the Senate, where there is little chance that the property rights of individuals or states, will survive. 

HR.3534, Consolidated Land, Energy, and Aquatic Resources Act of 2010 (Reported in House – RH)  will effectively render a greater amount of land as owned and/or controlled for profit, by the federal government along with minerals and water rights to now be controlled by the federal government and enforced through the BLM and other newly created enforcement agencies. Last week the Bureau of Land Management (BLM) fell right off from the radar screen.  Besides conducting their murderous and heinous crimes on private property, so that the press and taxpaying public cannot observe, they turned off virtually every form of electronic communication.  It all fit the pattern of cloak and dagger, dark and dirty acts needing to be concealed and of course; they are not only above the law but well beyond being burdened with any fair and honest public opinion.  So it came as no surprise to me that their paranoia continued to grow.

Then a mass email from one Debbie Collins, an alleged member of the “BLM WH&B Team”, entered the fray and Ms. Collins used the email address of wildhorse@blm.gov.

The content of Ms. Collins’ email was so outlandish and inaccurate, as per the BLM’s own numbers, that it demanded a response so I gave in and actually ran out of steam after answering just two of her erroneous and incorrect statements.  So I sent the following email to the above address:

“Unfortunately, between the BLM’s high priced publicity agents and attorneys the judge and the public were fed a cock and bull story about how the horses were dying of thirst and had to be “rescued”.  They did not need to be rescued the week before, the month before or whenever but just during the hearing, they were in danger.  (Of course, the BLM had sold off all of the water rights and has allowed private fences to be erected around water sources so that wildlife has no access but what the hay, it’s been like that since 1916).”

People Who Live In Glass Houses Shouldn’t Throw Stones!

Today Director Bob Abbey, Director of the Bureau of Land Management (BLM), issued a statement which in a nutshell says that the “BLM’s goal is to enable healthy horses and burros to thrive on public lands”.  In the real world I would love to believe those words but the reality of the matter is that the statement is as far from the truth as is the freedom of 38,000 wild horses held in pens with no hope of living out their normal lives.

His statement is inserted in its entirety, below, and instead of going over and rebutting each and every word it is far better to simply state that the BLM has been in the business of using and abusing wild horses for decades.  The spirit of the law no longer applies to Mr. Abbey as is evident in the events of just the last several months.

Abbey, himself, cannot even get his numbers straight with against the latest press release from his own agency.  We have been reporting for the past year that the BLM does not have a clue as to how many horses are located on the public lands yet they continue to hand out grazing permits to private cattle owners so that the horses are so far out numbered that the going ratio is at least 50 to 1 in favor of the cows. More

A Working Man’s Perspective on the BLM BS

You see it on their website, you hear it in the mainstream press, you get slammed with it on social networks; the Bureau of Land Management (BLM) is launching a professionally orchestrated propaganda campaign that is aimed at subverting the First Amendment while pumping John Q. Public’s mind full of misinformation and twisted facts.  “Well, if it comes from the government and you see it in print it has to be right, right?” – WRONG!

Recently Debbie Collins, spokesperson for the BLM, issued an email that simply makes you think that Rod Serling is going to walk around the corner at any moment and say, “Welcome to the Twilight Zone”, it’s just that bizarre.  The truth is a very bitter pill for the BLM to swallow and one of the biggest sources of truth on the internet are independent blogs and comments on social networks.  Some of the biggest customers to most of the “Bad Blogs”, as dubbed by the BLM in a secret report several months ago, are actual employees of the BLM themselves.  Most of these wanna be cowboys, or girls, don’t have enough computer savvy to realize that a lot of us know how to ping IP addresses and can easily see that a large majority of the hits have a very familiar “blm.gov” component in them.

So in a nutshell; the free and knowledgeable voice of the American public is a very scary force to those who know that they are operating outside of the spirit of the law. More

“Meanwhile, the Department of Interior’s Bureau of Land Management is rounding up our wild horses with a vengeance because there’s “not enough water for them to drink.”  (A horse only drinks about 10-15 gallons of water a day.)  It seems that DOI Secretary Ken Salazar has spent all of his time envisioning the “new direction” with his Wild Horse and Burro Initiative, which will take our wild horses off their federally protected lands and use taxpayer money to put them on preserves.”

Just one mine in Nevada (Barrick Gold’s Goldstrike Mine) has pumped over 383 BILLION gallons of water from an aquifer.  (and that was a 2005 statistic, so it’s much more than that by now)  According to a New York Times article by Kirk Johnson, nearly 10 million gallons of water a day is draining away from the driest state in the nation. A big Stinkfly award goes to Ken Salazar!

Ken Salazar, quite possibly one of the most insidious characters to occupy an appointed federal office since maybe, Donald Rumsfeld, has just topped his own high measure of malfeasance.  Heading up what has become notorious for being one of the most grossly mismanaged agencies of the federal government, the Department of the Interior (DoI), Salazar has set into motion some of the worst plans and policies ever implemented by the DoI.  Among these policies is the eradication and zeroing out of herds of wild horses and burros all supposedly protected under the 1976 Wild Horse & Burro act. 

Its unfortunate that the 1971 Act contained no provisions allowing for the protection of the herds from the BLM, itself.  The BLM represents the most formidable threat not only to the wild herds, but also to the environment and biodiversity as well.  More

Renewed Motion Filed to Stop Rock Creek Wild Horse Roundup in NV
Herd Watch Director Continues Fight for First Amendment Rights
Reno NV (July 23, 2010)—Laura Leigh, Herd-Watch Director for the Cloud Foundation and journalist, filed a Temporary Restraining Order (TRO) in Nevada Federal District Court today to halt the Rock Creek Roundup and prevent a repeat fatal summer roundup and the shutting out of the public and plaintiff from observing wild horse roundups.
Nevada,
“We’re talking about a matter of public interest,” explained Leigh’s attorney Gordon Cowan. “This is a hot button issue here in Nevada. To prevent the public and press from observing the government in action on public lands is shameful.”
Leigh is asking the court for the following:
1.) Immediate cessation of all horse gather activity in the Rock Creek and 
Little Humboldt Horse Management Areas in northwestern Elko County, to 
maintain the status quo until the matter may be heard by the court.  There 
is no purported emergency or pressing urgency to remove horses from 
purported drought conditions as was contended by Defendants, in 
Owyhee:
 
2.) A Temporary Restraining Order enjoining the government Defendants 
from conducting helicopter wild horse gathers during summer months and 
so close to the foaling season.  There are many foals three months in age 
or less, running alongside the hips of their moms.  If removal of some of 
these horses is necessary, in that event the Defendants can reschedule 
and complete this process in the Fall season or at the end of Summer 
when temperatures are more mild and foals are more mature and better 
adept at withstand the gather.  To gather at this date is inhumane and 
directly contradictory to provisions of the Free Roaming Wild Horse and 
Burro Act of 1971; 
3.) A Temporary Restraining Order that at this point requires the Defendants in no uncertain terms to include and accommodate members of the public, the press and journalists including Ms. Leigh and others who are not hand-picked by the Defendants, to view every step of the process of 
gathering horses from public lands, such that the Defendants’ gather 
method and process becomes open and transparent from beginning to 
end, rather than secretive and hidden from the public as it is currently; and 
such that the method of protecting the health and safety of the public 
during these gathers is not used as the excuse to restrict, limit or 
otherwise offend First Amendment speech and press concerns but 
instead, ensures independence in observing and reporting the 
Defendants’ gather activities in a method encouraging liberal access and 
safe accommodation to the public including Ms. Leigh, to observe and 
record these gathers; 
4.) To require the Defendants to conduct such gathers on public lands should private land owners not be willing or able to accommodate members of the public, the press, journalists or other interested persons including Ms. Leigh, in their observation of these gathers. 
In his decision issued on July 16, Nevada District court Judge Larry Hicks recognized that the Owyhee complex roundups consist of three distinct and separate actions. Although BLM presented to the court claims that an unexpected and unprecedented emergency existed in the Owyhee herd management area, no emergency either claimed or proven exists in Rock Creek were BLM is currently rounding up horses. The public was permitted to observe the roundup for a short time only today. 
“We hope the TRO will be granted and the case can be heard before all the horses are gone from Rock Creek and Little Humboldt herd management areas,” stated Leigh.
According to the TRO the BLM used the “private property” tactic to strike fear among those seeking to observe the Defendants’ gather operation.  Members of the public were threatened with immediate, on-the-spot arrest should they “trespass,” intentionally or not, onto the very land the Defendants chose to set their horse traps to complete the Owyhee gather.
Nearly two-dozen wild horses, including many foals, have already died as a result of the BLM’s Tuscarora roundups from which the agency plans to remove 1,100 wild horses and leave only 440. 
Contrary to the BLM’s spin that the Owyhee horses were dying due to lack of water in their environment—a so called “emergency”, veterinarian Nina Windand goes on the record to explain the wild horses died due to the lack of proper care after being rounded up and stressed in desert heat.
“The lack of controlled reintroduction of water to these dehydrated, overheated recently stressed horses and the failure to use commonsense horsemanship by letting them drink ad lib under these conditioned caused unnecessary deaths by water intoxication,” states Nina Windand, DVM. “It is my opinion that this constitutes negligent management and that had expert or even common sense management prevailed a plan for gradual rehydration would have been instituted before the gather was in progress, not after the initial wave of deaths.  I further believe that leaving animals in this condition without overnight monitoring was a lapse of professional judgment.” 
Dr. Windand condemns the Owyhee roundup saying, “The uncontroverted fact remains that nearly all horses who reportedly perished, did so during the process of gather itself or immediately thereafter while the horses were in the custody of the BLM, but not before”.
BLM continues to ignore both the public’s first amendment rights and wild horse welfare.  Advocates are outraged that BLM continues forward, at rapid speed, with their multi-million dollar roundups as the agency strives to remove more than 6,000 wild horses and burros in the next three months.

Elko, NV (July 15, 2010)—Mustangs of the Tuscarora/Owyhee Complex in NE Nevada are now the focus of a BLM “emergency” as the agency claims that they don’t have enough water. The issue is not one of lack of water but prevention of access to water as the Tuscarora mustangs must navigate a maze of livestock fences and closed gates. Miles of fencing prevent their free-roaming behavior and ability to access water sites they’ve used for decades if not centuries. 12 Tuscarora wild horses have died after BLM contractors used a helicopter to roundup 228 of them in less than 150 minutes on July 10.  Prior to the roundup BLM told advocates that they were confident this was a reasonable window to remove horses in and maintain their good condition despite the presence of very young foals and the heat. However when the first day proved to be fatal and the roundup placed on hold, BLM began referring to the horses’ situation as an emergency. BLM now states that “an escalating drought” necessitates an emergency “gather.” However this is a typical weather pattern for the area in the hottest month of the year and the Cloud Foundation points to the fencing off of water sources and division between herd management areas in the complex as the root cause of their “emergency.” More

Reno, NV (July 12, 2010)—The Cloud Foundation and the public learned yesterday that seven wild horses died after being rounded up on the first day of the Tuscarora (Owyhee Complex) roundup in Elko County on Saturday, July 10. The Bureau of Land Management’s (BLM) contractor, Cattoor Livestock, rounded up 228 horses in less than 2 ½ hours over dangerous terrain. Choosing to begin the roundup on private land, BLM prevented the public from observing the first day’s roundup and the condition of the horses after they were captured. The Foundation strongly advises that humane observers be present at all times during roundups and processing to ensure the humane treatment of America’s iconic herds. 
“In light of yesterday’s devastating news, we call for an immediate stop to summer roundups,” states Ginger Kathrens, Director of The Cloud Foundation adding, “Tuscarora is another example of BLM’s reckless agenda.”

Bloody BLM roundup results in more than 140 deaths of federally protected animals
 
Colorado Springs, CO (July 10, 2010)—A contract between the $3 billion Ruby Pipeline project managers, El Paso Corp of Colorado Springs, Colorado, and energy giant, British Petroleum, was uncovered this week by ATS News, the investigative journalism arm of number-one “alternative topics” web site, AboveTopSecret.com. The contract reveals how BP stands to reap millions of dollars from the proposed 675-mile pipeline from Wyoming to Oregon. Ruby would destroy areas of pristine wilderness in northwestern Nevada, formerly home to the majestic wild horses of the Calico Mountains. Hundreds of young wild horse foals risk death in imminent Nevada roundup
Reno NV (July 9, 2010)—One woman from Herd-Watch, a program of The Cloud Foundation, studied the newly published Bureau of Land Management (BLM) Wild Horse and Burro handbook and caught BLM in the act of violating their own protocol for the Tuscarora (Owyhee Complex) roundup. The handbook states roundups are prohibited until six weeks after foaling season which ends on June 30th. Therefore the earliest date to start the roundup is August 11th. Laura Leigh, Project Manager of Herd Watch filed a lawsuit today in US District Court in Nevada to stop the roundup.
“I found their error right in the BLM’s management handbook,” explains Leigh adding, “The BLM disregards their own rules when it comes to ‘managing’ wild horse population.” 
Based on past experience and the current rush to remove 6,000 wild horses in three months, The Cloud Foundation believes that the BLM’s priorities are based on contractor availability not humane treatment of wild horses—especially foals, some of whom may be only weeks or days old.  More

BLM Helicopter Roundup To Begin Despite Presence of Vulnerable Young Foals

BLM starts dangerous roundup, violating their own protocol designed to protect wild horse babies 
Elko, NV (July 8, 2010)— Over 1,400 federally-protected wild mustangs are to be rounded up beginning tomorrow, July 9, in the Tuscarora area of Elko County Nevada during the hottest month of the year. The Bureau of Land Management (BLM) is violating their own set-protocol for waiting six weeks after the main foaling season, defined as March 1-June 30, so that young foals can escape the inherent danger of a high-heat summer roundup. BLM will dispatch privately contracted choppers to run the Tuscarora mustangs over miles of rugged terrain in a taxpayer-funded roundup expected to last three weeks and result in the removal of some 1,100 mustangs. Only last month, Oregon BLM wild horse managers postponed a planned roundup that would have started the day after foaling season—opting to begin instead in mid-August for the horses’ safety.
“If allowed to go forward this will be a massacre,” states Anne-Marie Pinter who rode the Pony Express Race through the area on her Spanish Mustang and saw small foals. “It is covered with razor-sharp, volcanic rock that will rip up the feet of these poor foals. Before riding the area, our event veterinarian strongly recommended that we put thick rubber boots over the metal shoes of our horses—the rocks are that treacherous. We experienced triple digit temperatures and had to constantly work at keeping our horses hydrated. I can’t even imagine the toll on terrified small foals and even the adult animals at the hottest time of the year. This amounts to horrible animal cruelty and no one will know what is going on because BLM has closed the area, even the roads.” 
Last winter, during the deadliest BLM roundup in memory in the Calico Mountains of Northwestern Nevada, at least two 6-9 month foals suffered a horrible death. Their hooves literally separated from their leg bones after running over similar terrain. Yet, BLM justified the dead-of-winter roundup by stating in their Environment Assessment: “Fall and winter time-frames are much less stressful to foals than summer gathers. Not only are young foals in summer months more prone to dehydration and complications from heat stress, the handling, sorting and transport is a stress to the young animals and increases the chance for them to be rejected by their mothers. By gathering wild horses during the winter, stress associated with summer gathers can be avoided.” More

To avoid conflicting with deer hunting season, the Bureau of Land Management (BLM) plans to unleash contracted helicopters in the August heat to round up 2,500 mustangs and burros, including their young foals, from the Twin Peaks Range near Susanville. Vastly outnumbered by thousands of corporate-owned destructive livestock, the public’s wild horses and burros are the BLM’s scapegoats for damage on the range. Well warm up the BBQ pit and break out the beer because the ole BLM is about to fire off a rerun of the death and destruction and hundreds of native wild horses are now doomed.  Gotta love that BLM, they just issued a statement that they know helicopters kill wild horses and what do they plan on using to round up the horses?  The same helicopter contractor that is responsible for running horses to death at the last roundup.  Craig Downer just verified that destructive private cattle out number the wild horses by a minimum of 10 to 1 at the proposed roundup location so what is the helicopter going to stampede; the wild horses, of course.  Kinda makes ya wonder about those boys, doesn’t it?

We all know that the BLM can’t count, they have proven that with their bogus numbers both before and after their botched roundups.  We all know that they lie and actually hire professionals to teach them how to do so with style.  Hell, look at their last advisory meeting; slick, cool and preaching transparency while they are castrating and killing off the last seed of the Calico herd.
