HOUSE JOINT RESOLUTION 1089

AS INTRODUCED
A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution.
WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows:
“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”; and
WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and
WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and
WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and
WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and
WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and
WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:
THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.
THAT this serves as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.
THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state’s legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

One more thing, Barbara; both the URLS you’ve provided have become truncated somehow. Note the … between portions of the URL. There is part of it that is missing. It seems to be that way in every website page it’s been inserted in, too. Strangely enough, I have just looked at OK-Safe.com’s website, where I would have expected it to be a huge headline item, but couldn’t find a single mention of it. Hmmm….and no mention of it on the state’s official website, either: http://www.ok.gov/
Methinks more than a few globalist infiltrators in Oklahoma’s media and government are responsible for this silence. No wonder your posting of this is the first I’ve heard of it. You would think there would be a huge parade going on and fireworks going off, but….nothing.
Now, THIS makes me proud to be an Oklahoman! We lead the fight against illegal immigration with HB1804 and many states and cities have followed suite. It is my sincere hope that will be the case for the other 49 states. Vermonters are talking about seceding from the union and there is a movement afoot to attractive people to move to Vermont who are in support of doing so. I invite anyone who wants to to move to Oklahoma, where we have the nation’s fourth lowest housing costs, lower taxes and a society that is not as subverted (yet) as those found on the east and west coasts. Plus, we have a moderate four season climate (if you don’t include the chemtrails over Oklahoma City). I’ve lived here nearly all my life (born here, too) and it’s been a great place to live. I’d like to KEEP it that way. Now it looks like we have a shot at it. Thanks, Barbara, for posting this. I don’t think the local news media covered it…cough, cough, ahem.
Go Oklahoma!!! This is the best news I’ve heard or seen in quite awhile! Finally! A state declaring its rights over the federal government!
